1. Scope

These terms and conditions govern the shipment of goods purchased from the Business within or outside the state of California when delivered via third-party carriers. By placing an order, the Customer agrees to comply with these terms. These terms supplement any Sales Agreement, Order Confirmation, or other contractual document unless otherwise stated.

2. Order Processing

  • Orders are processed within 1–3 business days, excluding weekends and public holidays.

  • Orders received after 5:00 PM PST or on non-business days will be processed on the next business day.

  • Customers can modify or cancel orders prior to shipment; once shipped, standard return policies apply.

3. Shipping Methods and Third-Party Carriers

  • All shipments are sent via reputable third-party carriers (e.g., UPS, FedEx, USPS, DHL, or other agreed carriers).

  • Carrier selection may vary depending on delivery location and shipping method requested.

  • Shipping times are estimates only. While we make every effort to meet the estimated delivery schedule, we are not liable for delays caused by carriers, customs, weather, or other factors outside our control.

4. Shipping Charges

  • Shipping fees are calculated at checkout and may vary by package size, weight, and destination.

  • Customers are responsible for all applicable taxes, duties, and import fees.

  • Offers of free shipping, if applicable, are subject to minimum purchase amounts as indicated at checkout.

5. Delivery Terms

  • All orders are shipped with FOB (Free On Board) Destination terms: the risk of loss transfers to the customer upon receipt of goods by the designated carrier.

  • Customers must provide a valid shipping address; we are not responsible for packages sent to incorrect addresses.

  • For P.O. Boxes, delivery is limited to carriers that service such addresses. Standard USPS delivery applies for domestic P.O. Box shipments.

6. Risk of Loss, Lost or Damaged Items

  • Title and risk of loss pass to the Customer once the carrier accepts the shipment.

  • If items are lost or damaged in transit, the Customer must notify us within 5 business days of delivery. We will assist in filing claims with the carrier but are not liable for damages incurred during shipping beyond assisting as required.

7. Returns and Cancellations

  • Return and refund processes are governed by our Return Policy [insert link or reference].

  • Customers are responsible for return shipping unless otherwise stated.

  • Cancellations of orders prior to shipment are handled per our order modification guidelines.

8. Shipping Restrictions

  • Certain goods may be restricted from shipment to specific areas, states, or countries. These limitations will be indicated at checkout.

  • Hazardous, perishable, or legally restricted items cannot be shipped internationally or to certain U.S. states without compliance with applicable laws.

9. Customer Responsibilities

  • Customers must ensure delivery availability and provide accurate shipping information.

  • Customers may be required to sign upon delivery as proof of receipt.

  • For international shipments, customers must comply with all customs regulations applicable in the destination country.

10. Insurance

  • Optional shipment insurance may be offered through the carrier. The Business is not liable for loss, theft, or damage unless insurance is purchased.

11. Limitation of Liability

  • Except where prohibited by law, the Business is not liable for indirect, incidental, or consequential damages, including delays, lost profits, or loss of goodwill resulting from shipment.

  • Liability for damaged or lost goods is limited to the invoice value of the shipped items.

12. Governing Law and Dispute Resolution

  • These terms and conditions are governed by the laws of the State of California.

  • Any dispute arising from or related to these shipping terms must first be addressed through informal negotiation, failing which disputes may be resolved through arbitration or court proceedings in a California jurisdiction.
